(the “Company”, “our”, “we” or “us”) respects the privacy of the users (“User” or “you”) of the Ketshwa platform , our online platform, and our website available at: www.Ketshwa.com (the “Platform”, “Website” and collectively the “Service/s”) and is committed to protect the personal information that its Users share with it. We believe
that you have a right to know our practices regarding the information we may collect and use when you use the Services.

Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use at www.Ketshwa.com/terms, which this Privacy Policy is incorporated thereto by reference.

BY ACCESSING THE SERVICES AND/OR USING THE SERVICES, YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY (THE “PRIVACY POLICY”), INCLUDING TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION (AS DEFINED BELOW) AND, IF APPLICABLE, YOUR END USERS’ (AS DEFINED BELOW) PERSONAL INFORMATION IN THE EVENT YOU DECIDE TO PROVIDE US WITH SUCH. IF YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT USE THE SERVICES.

Please note: you are not obligated by law to provide us with any Personal Information. You hereby acknowledge and agree that you are providing us with Personal Information at your own free will, for the purpose of providing you with the Services. You hereby agree that we may retain such Personal Information pursuant to this Privacy Policy and any applicable laws and regulations.

2. Which information we may collect on our Users?

We may collect several types of data and information from our Users:

  1. The first type of information is “Non-personal Informationwhich is non-identifying and non-identifiable information, without particular reference to the identity of the User from which such information was collected. Non-personal Information which is being gathered consists of technical information and behavioral information, and may contain, among other things, the identity and operation system and browser, OS’s version, User’s screen resolution, duration of usage of the Services, time of usage of the Services, User’s ‘click-stream’ on the Services, keyboard language, etc.

Other type of information is“Personal Information” which is individually identifiable information that identifies an individual, or may with reasonable effort identify an individual, either alone or in combination with other information, or may be of private or sensitive nature. Personal Information which is being gathered consists of the following:

For avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.

We do not collect any Personal Information from you or related to you without your approval, which is obtained, inter alia, through your active acceptance to the Terms and the Privacy Policy.

TO THE EXTENT THAT YOU PROVIDE TO US ANY PERSONAL INFORMATION IN CONNECTION WITH ANY THIRD PARTY, INCLUDING ANY OF YOUR CUSTOMERS OR END USERS (COLLECTIVELY, “END USERS”) YOU ARE SOLELY RESPONSIBLE TO RECEIVE AND HEREBY REPRESENT AND UNDERTAKE TO HAVE RECEIVED THE CONSENT, AUTHORITY, PERMISSION AND APPROVAL OF SUCH PERSON AND PROVIDED THEM WITH SUFFICIENT DISCLOSURES, TO ALLOW THE USE OF SUCH PERSONAL INFORMATION, AND TO ALLOW COMPANY TO ACCESS, STORE, COLLECT, ANALYZE AND PROCESS SUCH PERSONAL INFORMATION AS DETAILED HEREIN.

3. How Do We Collect Information on Our Users?

There are two main methods we use:

  1. We collect information through your use of the Services. In other words, when you are using the Services, we are aware of it and may gather, collect and record the information relating to such usage, either independently or through the help of third-party services as detailed below.
  2. We collect informationwhich you provide us voluntarily. For example, we collect Personal information which you voluntarily provide when you use our Services. We store the Personal Information either independently or through the help of our authorized third-party service providers as detailed below.

While the data protection laws in the above jurisdictions may be different than the laws of your residence or location, please know that the Company, its affiliates and service providers that store or process your Personal Information on the Company’s behalf are each committed to keep it protected and secured, pursuant to this Privacy Policy and industry standards, regardless of any lesser legal requirements that may apply in their jurisdiction.

You hereby accept the place of storage and the transfer of information as described above.

6. Non-Personal and Personal Information of Third Parties

To the extent the Company processes any Personal Information on your behalf when performing the Services, you shall be deemed the data controller and the Company shall be deemed a data processor, and in any such case: (i) you will collect, use, transfer and otherwise process any Personal Information collected by or through the Services in compliance with all applicable laws, enactments, regulations, orders, standards and other similar instruments, including but not limited to the data protection laws and employment laws; (ii) you shall be responsible for providing appropriate information and obtaining any required consent from End Users including via a published privacy policy, which shall include a notice and consent allowing it to own, control and transfer all Personal Information that is provided by End Users; and (iii) you have provided such information and obtained such consent to any processing of Personal Information by and through the Platform and Services in accordance with any and all applicable laws.

7. Sharing Information with Third Parties

The Company will not share any Personal Information it collects with any third party. Notwithstanding, the Company may disclose Personal Information in the following cases: (a) to satisfy any applicable law, regulation, legal process, subpoena or governmental request, whenever the Company believes in good faith that it is legally bound to share such information; (b) to enforce this Privacy Policy and/or the Terms of Use, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to User’s support requests; (e) respond to claims that any content available on the Company’s Services violates the rights of third-parties; (f) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (g) to protect the rights, property, or personal safety of the Company, its Users, or the general public; (h) when the Company is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (i) to collect, hold and/or manage your Personal Information through the Company’s authorized third party service providers, as reasonable for business purposes, which may be located outside of your residence or location (for example: data storage on Amazon Cloud Services) as described below; (j) pursuant to your explicit approval prior to the disclosure; or (k) cooperate with third parties for the purpose of enhancing the User’s experience.

For avoidance of doubt, the Company may transfer and disclose Non-Personal Information to third parties at its own discretion.

8. Deletion or modification of Personal Information

If for any reason, you wish to modify or delete your Personal Information please send us an email to info@Ketshwa.com, and we will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws. Note that unless you instruct us otherwise we may retain your Personal Information for the minimal period of time required to provide you with our Services, or pursuant to any applicable law.

Please note, upon request to delete your account, the Company may depersonalize (and un-identifiable) your Service activity history for the purpose of enhancing and improving our Services.

9. Minors

To use our Services, you must be over the age of sixteen (16). Therefore, the Company does not knowingly collect Personal Information from minors under the age of sixteen (16) and does not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of sixteen (16) are not using the Services.

We take a great care in implementing and maintaining the security of the Company’s Services and its User’s Personal Information. The Company employs industry standard procedures and policies to ensure the safety of its Users’ Personal Information and prevent unauthorized use of any such information. However, we do not guarantee that unauthorized access will never occur.

When you access or use our Services, the Company may use industry-wide technologies such as “cookies” (or similar technologies), which store certain information on your computer (“Local Storage”) and which will allow us to enable automatic activation of certain features, and make your service experience much more convenient and effortless. For example, the cookies will assist the Company to enable automatic connection to the Service. It is easy to prohibit the Local Storage, to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. You hereby agree that we may use your contact details provided during registration, for the purpose of informing you regarding our products and Services which may interest you, and to send to you other marketing material. Please note that the Company may also contact you with important information regarding our Services. For example, we may notify you (through any of the means available to us) of changes or updates to our Services, payment issues, service maintenance, etc. You will not be able to opt-out of receive such service messages.

The terms of this Privacy Policy are un-separated part of the Services and will govern the use of the Services and any Information collected therein, the Privacy Policy should not be separated in any way from The Company’s Terms of Use. The Company reserves the right to change this policy at any time, so please re-visit this page frequently. We will notify you regarding substantial changes of this Privacy Policy by changing the link to the Privacy Policy in the Service and/or by sending you an e-mail regarding such changes to the e-mail address that you provided during registration. Such substantial changes will take effect seven (7) days after such notice was provided on our Services or sent by email. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Services after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.

This Privacy Policy, its interpretation, and any claims and disputes related hereto, shall be governed by the laws of the Kindgdom of Jordan, without respect to its criminal law principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being litigated in and decided exclusively by a court of competent jurisdiction located in Amman, Jordan
